Is it illegal to play online in Germany, or is it just illegal to have a website on a server in Germany?

It's illegal to play.

But since the law likely violates the German Constitution, it's unlikely the state will attempt to convinct anyone for it. The State may get into trouble if the law is later deemed unconstitutional.

Legal experts also believe that it is unlikely Germany could mount a successfull prosecution of an operator based in another European Union country such as those in Malta or the United Kingdom.
