Microsoft signs Linspire to patent deal

This is not the end theirs still debain, mandriva, ubunto plus many, many more that will not sign their OSS soul away. And they would rather lose in the court room and fold-up than neal to two horn four eye billionaire anti-geek.

Microsoft has no leg to stand-on for software rights, if there is microsoft code in linux then microsoft underhandedly sub-mitted the codes themselft for approval to GPL at the same time they filed a patient application, thus making linux user in breach of microsoft own rights.

I was gong to buy a Dell with ubuntu but I like these new partnerships with Micrsoft. I'm shooting for Novells SUSE in order to get the compatiblity advantage with MS offce.

John Linux,

You don't seem to understand exactly what's going on with MS's claim to Linux. Its not that MS submitted code for Linux, if they did they would have waived their patent claim. But what happened is that other people have written code infringing on MS's patents that they then submitted. When those authors submitted the code they had to agree that they had all rights to that code, which they don't if it truely does infringe on any one of MS's patents. Its their fault, not MS's.

In fact, I bet MS does have legal standing if it is true that any of the code in Linux or FSF code base infringes on their patents. That's the bottom line, very black and white.

The fact that they are now getting people to sign patent deals with them is another win because if this issue is ever litigated there is an established industry precedent. As much support as the FSF has there will still be a hard battle if MS does decide to start a fight.

It's not the issue of litigation, it's the issue of basic human freedoms. Thousands of talented developeres (who do not get 100K/year by the way) writing free software and live on donations. And the reason they do it is they want to make world free for people like us who use their work and not pay a dime. When giants like Microsoft who has all possible lawyers in the world trying to prey on their work it just doesn't look right. It's like a high-school bully senior beating a first-grader because (fill that blank yourself). And the reason they're trying to do this is by no means because some super-intellect code that noone but high-payed M$ engineers can produce was stolen, but because they are directly targeting our wallets. If they could claim the air you breathe, they would. And trust me, time is coming, they WILL claim it.

I think I'm missing something. I am under the assumption that Microsoft has never released source code for any of it's products outside of Microsoft, right? So how in the hell do these developers infringe on code that they've never seen? If they create seperate code that performs similar functions, great! That's how the world works. You can't go around suing everyone because they make something that is similar to your product. Oh wait, it's Microsoft. 65 billion strong says they can go around suing anyone.

Pretty soon you'll just start having your paycheck docked with fees to Microsoft because they'll own the world.

Its not code that M$ is claiming was stolen, its patents that they have that they say Linux code is based from.

Copyright infringement and patent infrigement are completely seperate things, one covers the actual code and the other covers the functionality of the code.

Notice on all of the M$ deals its not copyright issues they're talking about, its patents. This has nothing to do with M$'s actual code, its the functionality in Linux that M$ holds patents for.

Some folks just have their head screwed on backwards... If they want winsux let 'em have winsux!!! Just keep that *#_@+!|+ M$ hand out of my Linux... buckwheat.
If you like M$ apps then use windows. But if like the rest of us who have been using Linux for some years now, you find that all this is moot because Linux is in the Public Domain... and M$ has not one whit of a prayer of stopping the Linux community, then join the fray! If you think that the cross use of Linux on Winsux is cool... then you are not even close to the heart of the issue... NUKE WINDOWS, put your mouth behind your keys... Use Linux instead of Windows. Use both if you have to! BUT NOT TOGETHER! They do not mix.(period) I personally refuse to assist the OS tyranny of M$ any longer! Linspire is a fraud just like the other wannabee lin/win garbage out there. Sorry about the harshness, but somebody has to say it.

i still learning about linux ,i have to say i love it, yet i don't know much about programming and all that , but i can say one think ,most of my life i spend in socialist country, and how oppression look like i experienced first hand,as far i can see bill wants just that.he already have it (total control over any comp using ms ) and that is all about control, so when You guys let him gain even more of it ,You`re living in china. period.
i am old guy now but i still dreaming i will die free using LINUX.

Linux nuts are just that: people that get caught up more in the movement than what it actually is. You idiots are talking about living free because you use Linux, that is the most moronic idea I've ever heard.

Get a reality check. Your world is no different if you use Windows vs. Linux. Your computer is just a computer, it doesn't matter what you do with it. 90% of the world is happy with Windows, for those that aren't go your merry way and use whatever else you want. But don't put people down for using Windows. A lot of people don't like to re-compile their kernel on Friday nights. Do yourselves a favor: go outside and see the sun. Maybe then you'll realize that a computer is just a computer.
