I cannot believe the words 'crisis' arose in this article. I have an mp3 player and a cell phone here in vegas and I can still be aware of my surroundings when i walk or take the bus anywhere, these people are to easily distracted. Now, the use of a cell phone in a car i can understand, but what about GPS navigators and blue tooth headsets? Technology is advancing to quickly and soon supposed bans like this won't be necessary

It is rather obvious that Mr. Kruger has Ipod Envy. He probably doesn't even know how to use it or any of the other 'new-age' technologies such as a Wal-Man.

This is the same idiotic reasoning that would be used to ban jewelry in public. Someone might be blinded by a flash coming of those sparkly ear rings and make you step into the street to avoid the glare and Gasp!!! get hit by a car.

If someone is so absorbed in his or her 'sound producing device' that he loses all senses, maybe we should clasify this as a controlled substance and charge people for DU-I(pod)'s.

My stomach is churning as I read this article. It is an invasion of personal rights and a typical example of government overstepping their bounds. What's next- a ban on hats that may block someone's view or perhaps a ban on sunglasses? Why not just ban walking on street altogether? Does anyone actually feel this is a product use of our tax dollars? I think I am going to go throw-up.

One thing to think about...
With this law in place, the next time someone gets squashed because they were walking in traffic, the city will probably be able to go after the pedestrian for money(more than $100) in court because they were breaking the law.

This is kinda similar to 'alcohol related vehicular accidents', which according to such statements amount to 50% of all fatalities. The conclusion is that drinking and driving do not mix well.

Gee, if people stopped driving all 100% of vehicular accidednts would be eliminated.

Why is that Kruger considers hend helds for deaths of those people, when it is the vehicles that killed them, or those driving them? Therefore, driving is what it should be banned - in the name of Safety!

New York State is the highest taxed state in the country. There are no jobs in upstate New York and our residets can not leave fast enough. This Senator like all our Representatives in Albany do not have an answer for our Real problems, but isnt it funny that they come up with idiotic laws like this. They like to let us poor serfs know they care about our well being.
As our New Govenor stated upstate NY is like Appalachia.

Are we allowed to talk to a friend that is walking with us? Then why shouldn't we talk on the phone? A live friend can be a whole lot more distracting than an iPod or cell.

We could require a common sense competancy test before allowing people to leave their homes without supervision. Oh, wait, that would mean most of our politicians couldn't go to work.

I, also, am disturbed by the use of the word 'crisis' to describe the problem. Granted there is probably an issue with distracted/unfocused people getting themselves and other killed and/or injured. However, has it reach the proportions of a 'crisis'? I though oil dependency, war, terror, medical costs, social security and illegal immigration were far more important.

Anyway, I also agree with the others here that say this is a personal privacy issue. I believe people have the right to use their devices. I just wish more people understood that having rights means also being responsible and having a duty of care to yourself and others around you.

Additionally, I am worried about the increasing level of government intervention these days. It seems that government feels the right and need to consistently dictate to people. This is most disturbing.

O Boy. Here we go. I reluctently voted Demo this time and now it appears that we are going to have 'do-gooder' legislation popping up all over the place. Does the proposed new law, if interpreted strictly mean that if I was in my car in New York and found myself crashed between two vehicles where I could not get out, I am not allowed to use my cell phone. Or if I saw another such accident involving other persons, I cannot use the cell phone either in my car or outside in traffic? I propose less laws and more sense for politicians. You elect politicians and as soon as they discover that they are in a class called 'lawmaker' they turn into idiots.

This contributes greatly to the stupidity of society. Switching topics...I always wonder how sitcoms are even on TV, with fake laugh tracks? To be sure, someone thought about the potential for dangerous interaction between moving vehicles and preoccupied pedestrian PD (personal device) users before hundreds of millions of the devices were dumped into the marketplace, no?!

Banning the use of handheld devices in NYC or any other city would be tantamount to Socialism, in my opinion. This proposed ban will not curb the use of these devices, it will just take us one step closer to corporal control and create a great deal more work for lawmakers and city officials who are already straining to deal with bigger issues like violent crime, child abuse, drug proliferation, etc. The burden of responsibility for PD use should fall on the user, not the lawmaker, the taxpayer, nor the City of New York. And the burden of responsibility for reducing vehicular impact with errant pedestrians and other non motorized users of city streets should fall on the vehicle driver, likewise. There is no better control than self control, and no better law than personal liability.

We do not need to get rid of the guns lady( comment in posted). This is about laws against carrying a ipod or like device while on city streets.

This is a stupid idea. I was brought up right, to be aware of my surroundings. If I should choose to wear my ipod, and have it a full blast, and come up on a street to cross, the right thing to do is remove the ear pods, and turn down the volume a little. Look both ways then cross safely. It is that simple.

But to create a law about this is very stupid I think.

I think there should be a law that forbids a father, or loved one, from abandonding a child in the cold weather, because he or she (child) does not want to go to sleep, then child wonders around in sub-freezing temps, and then dies.

The law should give very harsh punishment to somebody that does something stupid like that. We need more laws passed for childern, and their safety then these stupid things like this, would not or should not happen, more power to child protection agencenies.

Then the lady in one last comment wants to abolish something like guns. It is not the gun that kills people it is the stupid idiot that pulls the trigger. If their is no gun, he or she could revert to a chainsaw, drill, baseball bat, car, weedeater, knife, you name it to kill someone, do you want to ban all those.

If a bullet is laying on a counter, and an empty gun is on the counter, to have it kills somebody, then somebody needs to put bullet in gun, then pull trigger, notice it needed somebody to put it in there, the bullet does not just jump into the chamber to fire.

It's better then having some yahoo filing a law suite against the city because their love one was hit by a passing car while they were listening to their ipod or talking on their cell phone and there wasn't a law prohibiting hand held gadgets being used while crossing a street.

This proposal is absolutely absurd. Cell phones in cars are one thing. Trans-fats I can understand because of the easy replacements that can be made. MP3 players while walking? RIDICULOUS. How will a proposal like this eve get passed? And, just for sake of argument, if it is passed, how will it ever be enforced? There are 10 million people in NYC, 14 including tourists. There is no way this law could even be considered effective. I have to agree with the MASSES, this is an idiotic idea and a waste of time for both the Hill as well as the people. The Senator needs to use his head and prioritize his issues.

Its about not being distracted when you're driving. Radios dont require your attention. The option is open with a radio, no obligation or interpersonal involvement. I've personally seen people crying,yelling, & fighting on the phone with other people while driving. Driving is not a game, cars are not toys, and the road isnt anyones personal race track. Focus and attention shouldnt be compromised for a phone call. Turn it off and check the messages when you stop driving. Im sure the person calling you while youre deiving dosent mind waiting until you are out of the car and are not being distracted and endangered.
As for the dopes that cant cross the road safely, I agree its natures way of cleaning the gene pool.

Glad they are targeting the pedestrians on this one - what a terror they represent. Let's not do anything about the people driving while on their cell phone, it's the pedestrian's job to be alert so they can dive out of the way. It would horrible if some politician was blamed for killing a pedestrian while talking on his cell phone because the pedestrian was using his iPOD and didn't hear teh car coming.

In theory:

-People cross the street with traffic, not against it, so likely they're crossing in a crosswalk. If hit by a car the driver is the one at fault.
-If not crossing in a crosswalk, then the person is already breaking a never-enforced law, jay-walking. Why bring a new law that also won't be enforced?
-If people decide to cross against the grain of traffic, well, let them. If they are hit, that's more punishment than a $100 fine, and if they aren't hit then maybe there wasn't that much danger in the first place or they already took note of their environment and considered all of the options.
-NYC is a pedestrian city - any curbing of danger should be done on the side of motorists.
-Most pedestrian accidents are a direct result of NY Department of Transportation & the NYPD not making lights long enough, not enforcing red lights & stop signs, and not enforcing the speed limit.

I know that the problem would be solved by enforcing existing laws, that's a no-brainer. But I'm a politician and I do things to look good, not because they matter. This makes it look like I actually care about the idiots who got hit while listening to their iPods while simultaniously creating a possible new revenue stream. This will also give the police a reason to stop someone they don't like the looks of without consequence. And best of all it doesn't affect me because I don't own an iPod or walk anywhere, I'm too important for that nonsense.

What I want to know is, who is going to protect the secondhand user? The other day I was walking in the East Village when I noticed a fine mama dancing in front of me as she walked while listening to what must have been a great song on her mp3 player. Soon, I was entranced by her gyrations, and her groove was juxtaposed with my psyche, and I too found myself 'jumpin to da beat'. I've never felt so alive, so carefree. Suddenly, I heard a terrible screeching sound followed by a horrific rush of air and I awoke from my trance to find that I was standing right smack in the middle of the street on the backside of the truck that had just missed me! I ran before the driver could get to me and soon I was safe in the alley with my 40 and a fresh shot of pure adrenalin. I could have been killed!

I couldn't find that girl anywhere, and when I called the police to complain they just laughed at me and told me to stop bothering them. Now tell me, Who's going to protect MY rights?

You know, I think he has the problem well characterized, but his solution sucks.

What he wants to do would restrict the freedom of everyone who uses electronic devices. What we need to do is target the threat to public safety.

I propose they simply make it a crime to 'walk into cars, trucks, or buses while using an electronic device'.

See how simple it is to rephrase the law in a way that doesn't infringe on everyone elses rights ?

Carl Kruger comments about Ipods.What killed those pedestrians is, NOT LOOKING BOTH WAYS-WHEN YOU CROSS THE STREET.Its not ther Ipods stupid.THINK about it-if you look first-you wont get hit by a vehicle.There is a BAD epedemic of people male and female just walking into the street to cross without looking.N.Y is bad, but Boston is the worst city in U.S.A for Jwalkers it is bad, but look at the Mayor they have in Boston. Didnt he just waste 75,000 dollars on taking down advertisement signs thinking they were bad or something.Now this Carl Kruger wants to waste more taxpayers money.

though i share the common opinion of this article and the replies to it that this is primarily a natrual selection issue, i grossly disagree with the statement that the laws need to be tightened on the drivers. giving pedestrians the right of way is bad enough already. too many people that need to fall into the darwin awards nomination list abuse this rule to think that they can stride into a street and expect cars to stop. not enough of them realize that there are laws regarding a pedestrian leaving a protected place. my opinion is that the car weighs an order of magnitude more than a person... if that person values their life, they should watch out for the car. it's too easy for stupid people to survive in our world already, and every one that we save is one more that's in our way.

I often wonder about the thought processes of our elected officials.

When I sit down with my family to discuss the problems that confront us and require the immediate attention of our Federal and Local Lawmakers, handheld devices doesn't make the list.

The main categories being Taxes,Violent Crime, Environment, Security and Education, Cost of Utilities are major priorities. Under each category I can honestly say that that I can add a minimum of 6 subjects.

The latter adds up to 48 subjects.

If Mr.Krueger has a minimum of 48 subjects that he is working on, he might call me and I can suggest more substantive subjects than the legislation he is proposing.

Clearly the hearing impared should not be allowed to walk anywhere. I must agree, however that police need more excuses to harrass, question, and detain people who don't look like police officers or bankers. It's getting to the point in this country where one in a thousand cases where a citizen is searched for probable cause on the grounds they looked suspicious is 'not good enough' for a court of law.

We need to eliminate the need for probable cause completely by criminalizing everything before the bleeding hearts start curbing the nearly exponential growth in the largest prison system on the planet since the break-up of the Russian Gulag. Where will we be then? Would we even be Amerika anymore if we didn't have the highest per-capita prison population in the world by a factor of nearly 20? Be careful - if we just let out 98% of our prisoners we'd be just another average country in terms of per-capita prison population (well, ok, we'd still be close to top in the world, but we would have lost our order of magnitude lead in this critical indicator of societal health).

We are the greatest!!!

If the senator want to make a statement well, we have poor people that need help, a disfuntional MTA system, a broken down education system that ask for money and our kids are failing in the system. They should just ban all distractions at crosswalks... billboard adds, books, newspapers, fancy cars that will draw attention, gorgeous women, street signs. You should also get fined if you talk to yourself while crossing the street. Oh, and you're not allowed to blink either. You must pay attention to your surroundings at all times. Blind or deaf?? Then you are not allowed in the crosswalk. Sorry.

lol, banning ipods is like forbidding people to laugh. either way, its the fault of the person who is listening to their ipod. A ban restricting the volume of ipods, as has been done in europe, would be smarter.

With all due respect to the NY Senator a distracted driver behind the wheel of a 2 ton vehicle is far more dangerous to many more people than a single pedestrian with an iPod or other device is to him or her self.

Silly Americans (just kidding). Why not solve the real problem and vote people into office that won't bring these outlandish laws into the light of day, then give Ipods to the fools that are voted out and get them out on New York streets with them. That should clear the gene pool pretty good.

I LIKE this idea. We need more ideas and laws like this to make everyone behave properly and safely. We need laws to tell us how much sleep to get and when to go to bed. Maybe governement enforced bedtimes and automatic lights out. Then everyone would be more wide awake and could work harder the next day. We also need MORE laws telling us what we can and cannot eat. Then we would all be healthier and could work harder. Please Senator Kreuger don't stop with this one law regulating Ipods and cell phones. Please , oh please , draft a personal code of conduct for ALL ares of our lives so that we will never be in danger again. After all we would want to walk around New York like zombies, would we?

A crime is when one person infringes upon another's life liberty or property.
But now we have this wonderful thing I call 'pre-crime'. That is when you do something that someone else was also doing when they commited a crime. Prime examples are guns and drugs.
In a Socialist society the government takes care of you because it knows better. Then personal choice becomes a crime in the name of 'The Greater Good'. Prime examples are smoking and trans-fats.
Now with torte lawsuits going absolutely nuts because nobody is responsible for their own actions there needs to be a law to decide everything.

The purpose of this law is to decide blame in an accident regardless of the circumstance. If it goes into effect then it doesn't matter if the pedestrian stepped out of nowhere or if the driver was fishing for that crack rock he dropped on the floor, it will be the pedestrian's fault.

It seems to me that there are numerous deaths between pedestrian and motor vehicle each year. With the rise of cell phones and ipods wouldn't it only seem natural that some of those same deaths would include individuals using those devices?

This is the most retarded thing that I have ever heard of! I do believe personally, that this pending law is completely, and utterly idiotic. There is no reason to ban things that other people use everyday. What happens if your daily exercise is jogging???? Perhaps, you walk around while you’re shopping with an IPOD in listening to your favorite music to keep you busy and occupied? It’s not right, or fair to those people who are injured. Some people find them soothing in a city like New York City. Why would you want to ban something that keeps most of your people happy? Especially when they don’t complain, maybe it was the people’s own fault because they were too distracted by the device. Stupid people ban stuff from us for no reason what did the IPOD do to him? Gawd its not like they are attacking him while he's sleeping or in the shower? Come On?

I personally think the ipod is stupid! Seriously a butterfly can distract someone and cause them to walk into a car whose driver is not paying attention. Jezz, how stupid can you people be?!? Laws create criminals out of thin air.

Why don't we go after the real criminals instead of creating new ones?
Answer is control.
Violent people on the street are an excuse to have more men in uniforms with guns on the streets. It is more politically benificial to create more criminals than to go after the real ones, and besides if you don't use an iPod and it doesn't affect you who cares?

What the ipod focus ignores is the number of people walking around with them - of course some people who have them are going to be in accidents, but that doesn't make a causal link. There is similar 'evidence' that wearing clothes while walking is dangerous. Perhaps there should be a ban on that, too!

It's just hype. The 'Politician' probably doesn't expect or care if it passes, he just wants his name associated with the 'issue', to increase his visibility. Regardless of the outcome, his name will live in infamy (or so he hopes) just because he's sponsoring it. People are vain. This guy just wants to see his name in print.

I'm not down with the hater comments about natural selection. The incidents involving death with an iPod may totally be a coincidence. Who among us witnessed the actual event? Probably no one.

Everyone will die eventually and that's a fact. Who are we to decide who should die when? You expose your own arrogance when you make a statement favoring someone's untimely demise from an accident. Don't be a pompous jerk like the Politician sponsoring the bill or you'll be treated like one.

Wow. That's amazing. An iPod is a portable device for a reason... because it's portable? Available, on the go... etc.

So people get hit by cars.... OH well! Don't we have a population problem ANYWAY? This natural selection thing may not be so bad to stop!

As for the people IN the cars who hit the people rocking out, pedestrians have always had the right of way... quit hitting them - duh. There's these things we call eyes. Use them... it doesn't take much.
