The heiress and TV star had been charged with stealing a copy of the infamous sex tape "One Night in Paris" from a newsstand in Hollywood.
The TV show "Celebrity Justice" showed a security video of Hilton appearing to take the video from the stand. The person running the stand told the show: "She threw her 80 cents change at me and took the video and said, `I'm taking this and I'm not buying it."
However, it now seems that there is insufficient evidence to prosecute; the district attorney office said that the evidence presented to them was not so convincing that it would lead to a guilty verdict and that they would not pursue the case.
