Usher's custody battle will go ahead despite his stepson's death.
The 'OMG' hitmaker had asked for the court date in his battle with former wife Tameka Raymond to be pushed back after her son tragically died following a jet ski accident but the judge has ruled against him.
The trial will now resume on August 13 and is only expected to last a few more days, according to gossip website TMZ.
Tameka had claimed Usher's request was merely a ploy for sympathy and said Usher only came to visit her son Kile Glover - from a relationship with former partner Ryan Glover - once while he was in hospital following the accident.
She is locked in a bitter custody battle with Usher over their kids Usher Raymond V, four, and three-year-old Naviyd Ely Raymond and claimed his request to delay the next hearing in their court case was merely a 'transparent sham'.
She asked the judge to deny Usher's request and force him to appear at the next scheduled hearing, claiming that resolving the custody battle is the only way she can move forward.
Usher had claimed Tameka would get an unfair advantage in the hearing because the court would not want to rule Tameka so soon after the death of her son but the judge is pressing ahead regardless.
