DJ AM, who survived the deadly September 19th plane crash was also rumored to be scheduled to fly on the doomed Continental flight that crashed in Buffalo last month.
But according to DJ AM's publicist, Goldstein never even was booked on that trip.
TMZ reported earlier that he opted out of the flight that killed 49 people on February 12 in upstate New York, because he "had a bad feeling about it," according to their source.
But DJ AM's publicist later contacted TMZ and said his client was "never booked on the Continental flight" and was in fact performing at the time in NYC.
People.com reports that the plane maker Learjet and several other defendants are being named in Goldstein's lawsuit.
Goldstein wants $10 million for medical damages, lost earnings and profit, and the same amount for mental and physical pain and suffering.
The Associated Press claims a jury will decide if he is eligible for any damage awards if the case proceeds to trial.
Goldstein and rocker Travis Barker were the only survivors of the crash, which killed Barker's assistant, Chris Baker, and the Blink-182 drummer's bodyguard, Charles "Che" Still, as well as the pilot and co-pilot.
Both Goldstein and Barker escaped with serious burns that required lengthy hospital stays. Barker, AM, Still's mother and Baker's widow have all filed wrongful-death suits against various companies that they allege were responsible for the accident.
The trial is delayed until the completion of a government investigation into the September 19 crash.

$20 mil? This donkeyclown has received a fortune in free publicity from this. I mean - who the hell had heard of this dork until he crisped up a bit?
