Actor David Duchovny dropped a lawsuit he filed last month against London's Daily Mail. EPA/DANIEL DEME The suit was over an article alluding that he had affairs while married to his wife, actress Tea Leoni.Duchovny, 48, wanted $1 million in damages.

Now the Daily Mail reports that a brief dismissal of the case was filed Thursday by Duchovny's lawyer, Stanton L. Stein.The complaint was dropped "with prejudice," effectively killing the suit forever.Duchovny and Leoni are currently separated.

In his lawsuit, Duchovny accused the Daily Mail of posting a story online last month that claimed he had a history Edit Pakay.

The Daily Mail story was removed from the paper's Web site. But other news outlets including Monsters and Critics picked up the story and covered it on their Web sites, which allegedly "caused additional stress" to Duchovny, the lawsuit stated. The lawsuit stated Pakay was "a friend" of Duchovny's and they "played tennis a few times."

Recently rehabbed sex addict Duchovny stars as Hank Moody in the hit Showtime series "Californication," now into its second season.
