Mark Werksman, O'Neal's lawyer, told People magazine that his client didn't own the drugs found in his home.
"Those were not Ryan's drugs, he doesn't use drugs, and has nothing to do with them," attorney Mark Werksman said Thursday. "It's a dangerous assumption for deputies to have arrested Ryan just because he was in proximity to the drugs."
How the drugs came to be in O'Neal's abode and bedroom were not addressed by Werksman.
O'Neal and his son (with actress Farrah Fawcett) Redmond were both arrested for alleged drug possession.
"This situation is very upsetting to Ryan because he's just trying to lead his life quietly," Werksman added. "I have full confidence that Ryan will be vindicated."
Fawcett reportedly "was asleep" in the actor's Malibu home at the time of the arrests per People's sources.
Ryan O'Neal, 67, and his son, Redmond, 23, were arrested Wednesday at the actor's Malibu, Calif., home after substances believed to be methamphetamines were found.
They are currently free on bail after posting $10,000 bond each at the Lost Hills Sheriff's station in Calabasas. Formal criminal charges are pending.
Ryan O'Neal was previously arrested in Feb. 2007 for an altercation with his other son, Griffin, where the charges were dropped by the DA's office. Griffin O'Neal has also battled addiction issues and caused a 1986 boating accident that resulted in the death of Francis Ford Coppola's son, Gian-Carlo Coppola.
O'Neal's daughter Tatum, arrested this summer in New York for drugs, spoke out on the latest arrest.
"I'm really worried about Redmond," the actress, 44, said to People. "I want them both to get better and get the help they need – especially my brother."
"[Addiction] runs in families. It's a disease," she adds. "I'm praying for both of them. I'm praying for my whole family. I hope Red will get treatment. That's what he needs. There is hope for Redmond. He deserves to have the life a [young man] – going to school, hanging out with friends, getting a job. I wish the best for him.”
