If anything, Don Imus made the Rutgers girls team more popular. He allowed them to have plenty of time in the media where they appeared to be above the fray - too intelligent to get into it with the moron who spouted idiocies.
I am, in no way, a fan of Don Imus. I think that he should have been off the air a decade ago.
I also believe in the right of citizens to sue, and am proud that we have a system in place that allows individuals to take on corporations and the upper class - theoretically, anyway.
However, it is obvious that this player sees this as her opportunity to cash in and that is all this suit is about. I guarantee that the lawyer approached her about it. And, I understand the attraction to it. She is not going to be able to leave Rutgers and pick up a multi-million dollar NBA contract, and not everyone has the opportunity to grab some cash from and undeserving rich man in life.
But, even though she was in college when it happened, she is a public figure when playing these college basketball games and I cannot see how this case makes it to trial.
What Imus was doing is - technically - parody of a public figure and that is protected speech.
If Imus was a standup guy, he'd take some of his settlement from NBC and give each player a set sum - and have them sign papers saying that they won't press legal action further.
He should have done this from the start, but he's not the brightest bulb on the tree.
If she tries to bring this to court, she may win, but it will blacken the eye of our legal system even further. The question becomes, where does it stop?
I'm not a fan of slippery slope arguments, but music artists call women 'ho's' all the time. Can they be sued for slander? Is it the addition of 'nappy headed' that makes it slander?
This will need to be defined to the granular level because this will open the door to all sorts of suits if she wins.
I wish that she could bury Imus for this, but under the existing system, I just don't see it.
Can we possibly make this any more ridiculous? Get over it girl - you probably ended up with more popularity than you ever would have gained had the remark not been made. Too much was made of it in the first place - and now you can waste the courts time in a frivolous law suit. Please, put on your big girl panties and get on with it!
Kia who? What good name are we talking about? I'd never heard her name until just now. The fact is, this is just another anonymous loser who's tryng to cash in. How about a little common sense here? Drop the lawsuit and file it under '$54 million pants' or 'Multi-million dollar cup of coffee.' These lawsuts are a disgrace to our society. The sooner people learn to work for a living rather than sue for big lottery score, the sooner the country will be back on track. This suit is pathetic and should never see the light of day, either.

The freedom of speech amendment would cover any remarks by Don Imus if the subjects in question did have nappy heads. Now nappy heads dont neccessarily mean anything derogatory nor does kinky hair, curly hair or even dreadlocks. This lawsuit is motivated by greed because the nappy headed biatch cant get a job anyway else.
Right, I'm sure she was really emotionally scared. I was called much worse on the school playground. OK, so she just realized now that this traumatized her? . . . please. She should be sued for wasting the courts time.
You can only bring charges of libel against someone who puts falsehoods about you in PRINT. Since Imus was on the air, this charge is groundless. Slander is a little tougher to defend against but as an earlier poster mentioned slander refers to a pattern of false speech which this one time, indirect reference to a plural entity cannot possibly amount to.
This is so ridiculous. Everything about this is ridiculous. I think that the whole thing was a waste of time and money. Call Imus whatever you will. I personally don't think he is very funny on any level but many people did. All the rights groups will jump up in arms about how she should be compensated for her treatment. The only compensation that they are going to get is from the media that pays to exploit her even more than Imus did. get a clue people, pathetic.

I'm sure that dragging the court back into the public attention is the perfect way to make things right and move forward. I had forgotten about the nappy headed comments until this came up.

I'm thinking that our poor victim here is starting to fall into definition #3 on both counts. They said in April that all they needed was a sincere apology. He gave them that. Now she is violating her own principles for cash. Looks like Imus was right in the first place. He should countersue her for misrepresenting herself and causing him to lose a great job. That, or the greedy little wench should move on with her life.

So is Kia Vaughn also going to file lawsuits against any one of a number of so-called rap music 'musicians' for libel, slander and defamation as a result of their bigoted and misogynistic lyrics? What a joke it is to see the selective outrage targeted at this one talk show host who made this solitary comment. It would appear that the hateful, violent, and profanity laced rap and hip hop music lyrics and the people who deliver this filth to the listening public are much more 'debasing, demeaning, humiliating, and denigrating' to Vaughn, her fellow players, and other females in a much more pervasive way on a daily, repetitive basis, with a much wider audience than Imus had.
It would appear that rap and hip hop musicians employ the use of 'slanderous terms as intentional, and are motivated by greed and financial gain: In using insults against otherwise innocent people, rap and hip hop musicians and their producers get higher ratings, making more money for them and their employers.'
The hypocrisy of this selective outrage constitutes a sad commentary on our society. I hope the public at large realizes how damaging this double standard is to acheiving a true sense of justice.
Let's shine the light on the real culprits, Ms. Vaughn, and extend your lawsuit to a class action type agaisnt defamation from other sectors of the entertainment world, and if not, simply drop the Imus lawsuit, so as not to cloak yourself in this 'selective outrage' hypocrisy.
Those of you who are not part of the Rutgers community have no idea what the repercussions have been from this. Undue, unwarranted and uncivil attention was brought on the team, as well as constant annoyance by every media in the world. If you think that having constant phone calls, tv cameras, radio and press microphones in your face, following you around, parking their vans in front of your house, interfering with traffic, neighbors, and your personal life is okay, then you need to think twice. Those women can't go anywhere without someone asking, telling, commenting, on the situation. There is no more talk of basketball and team efforts. It's all about that scum bag idiot Imus. He should be held professionally responsible for his defamation. AND IT WAS DEFAMATION of character. Listen to his whole spiel and you will see that he thought the white girls on the other team were 'cute' but chose to call the Rutger's team 'whores'. If that's not defamation, then what is.
