Howard K. Stern is executor of Smith's will

FORT LAUDERDALE - Breaking news in the Anna Nicole Smith posthumous battle between Howard K. Stern and Virgie Arthur and Larry Birkhead.
The Florida court has released what attorneys say is the last will and testament of former Playmate Anna Nicole Smith, aka Vickie Lynn Marshall.
CNN's Susan Candiotti now reports that the judge overseeing the dispute over her burial has revealed that the current legal father of baby Dannielynn, Howard K. Stern, is the executor of Smith's 2001 drafted will and has full authority to execute her will and estate. All of Anna's assets to be held in trust for her minor children until they are 21 by Howard K. Stern. This will is not officially probated yet.
Stern's attorneys say Smith bought a plot in the Bahamas, next to the plot where her son, Daniel, is buried. He died in September, three days after Smith's baby daughter, Dannielynn, was born at a Bahamas hospital.
Broward Circuit Judge Larry Seidlin also signed an order to have Smith's refrigerated remains embalmed. No death certificate has been issued yet.
"We're beginning to give her peace," Seidlin said.
Seidlin ordered Stern to appear at the hearing Tuesday, and he is expected to testify. His lawyer, Krista Barth, argued unsuccessfully to have him appear by video phone from the Bahamas, where he is caring for Dannielynn.
Ron Rale, an attorney who represented Smith in a California paternity case, had told CNN's Larry King that Stern is not named as a beneficiary in Smith's will.
"Larry, I would like to reveal it on your show. Another little tidbit. I think everybody will see that Howard Stern is not a beneficiary of that will," Rale said.
On Friday, Seidlin directed that the will be filed in connection with the burial dispute so it can be entered into evidence.
Smith wanted to be buried in the Bahamas, attorneys for Stern insist. Smith's estranged mother wants to take the body home to Texas for burial in the family plot, her attorneys say.

Anna should be burried with her son.
This is a no brainer, Anna would have wanted to be buried beside her son. What does her mom have to do with anything, she stated publicly on numerous occasions, that she hated her mom, and wanted to have anything to do with her. I hope she finds peace wherever she is, cause it is pure chaos in the 'REAL' world.

I find it very peculiar that Stern didn't buy three grave sites instead of two because he is trying to pass himself off now as a husband, but he apparently felt that he would not be buried with her. Surely if she thought that he was her husband she would have insisted that another space be reserved next to her son and herself.
Thank God Hodward is incharge. Anna seemed closest ti him, had a mock-up wedding, plans for a 'Offical' wedding, traveled around the world with him, publicly HATED her mother. Do we all need MORE proof/signs?

Ok, so she hated her mother...what part of that doesn't that old lady from Texas understand? It's not complicated. I wouldn't want to be buried in Texas either but it'd sure beat being alive in Texas living with that old woman up your business all the time. Yuck.
I truly believe that Anna and her son were murdered by Stern. Stern is nothing but a gold digger. Although I do believe that Anna would want to be buried next to her son, I hope that Stern losses everything. After custody of Dannilynn is given to Larry Burkhead it will not be long until we see that Howard K. Stern takes his own life.
This is a sad situation. Anna Nicole had a somewhat miserable life and now she's being ridculed again in death. I feel for her baby who is left without a mother. Howard Stern has been there with her each time there was a tragedy. It's sort of strange that he doesn't know more about what happened to her on the day of her illness and death. I do feel that her remains should be in the hands of Howard more so than that of her mother due to the fact how Anna felt about her mother. It's just a sad, sad, sad, situation. I hope that the baby will be well taken care of.
If Stern didn't outright murder Anna Nicole, he sure didn't push her into treatment for addiction. I wonder if she was even getting treatment for depression over the death of her son. Going public might have forced her in. As her lawyer he was derelict for her not updating her will when she became pregnant again. Her most recent will looks like 2001, but what interest would he have in bringing forth a new one!
My son overdosed in 2005. It is tragic that she can't be there for her little daughter, but I sure can understand why she would plan and execute her own death.
This has all the trait of the perfect murder:
The victim (Anna), a widow, inherited a huge sum of money in a way that a lot of people would disapprove. She seems to be living out of control. She is totally at odds with all members of her family, except her son who suddenly dies of an overdose. She is all alone, and possible suicidal. The only one there to protect her is the lawyer, presumably husband and the father of her baby, who have all access to her money and will. Now she's found dead by inexplicable causes and he is to inherit all her money through 'their' child.
Maybe I'm a conspiration theorist, but you can't ignore the circumstances of her deaf.
As the real issues of today become more heated, we are fed more and more of this 'Celebrity News'.
I hope Anna's wishes are respected. She obviously wanted to be buried next to her son. As for Mrs. Authur, giving birth does not make one a mother. Anna had no use for this woman and accused her of terrible abuse.( Which may have ultimately led to alot of Anna's self destructive behavior) And while many outsiders and voyers have denigrated and scorned Mr. Stern, the fact remains that Anna trusted him and I for one hope he winds up with everything. Did she have poor judgement? Who knows ? But, why should anyone's opinion matter more than hers? God bless and rest in peace Sweetie.

everyone is saying rest in peace anna but i'm sorry to say that sinners at time of death do not go to heaven. they are forever more in torment. i'm not being critical because noone knows except anna and God whether she repented before she died. the bible says that thou shall not put no other God before me and we all know that anna worshipped fortune and fame. pre marital sex with anyone is wrong and it sounds like she had plenty of it. for those of you that approved of her life style shame on you. what is that saying to our kids, that it's ok to live life that way. well, it's not. i'm not talking about her or putting her down or judging her but the bible says you will know a tree by the fruit it bears. i pray that she found God before she took her last breath. i agree thatshe should be with her son. as for Dannilynn i feel so sorry for her. she didn't ask for none of this. she doesn't know what's going on. i'm sure she is wondering where is my mommy. if anna was abused as a child then yes she was probably reaching out for love but yet that does not excuse her life style.

Religion has nothing to do with whether or not the proper person obtains custody of the infant left alone. Murder or a life lived poorly will not protect this baby. If Howard is guilty of playing dirty then I do hope the paternaty test shows he is not the father. When is the paternaty test and result getting done??? Where's the judge with a brain in all this???
Did Anna really did have this baby? With all the pictures that were taken of her I have yet to see one of her pregnant. I don't believe that she had a problem being photo graft while she was fat, so why would she have a problem being photo graft pregnant.
Either way, I feel that she is finally happy with her son in heaven, because her entire life was hell.

It seems strange that no one is looking at Stern's complicity in the son's and mother's death from methadone overdose. Motive and Opportunity, No?
Its a no-brainer. Stern is the executor of the will. Will points to son, Daniel, who died. Next of kin is the daughter who inherits millions. What remains to be seen is who is the father. A simple paternity test will prove it.
It is a question of the father. Is he honorable? Possible fathers should submit to a blood test or some ofther test to prove positive who the father is. The father is blessed, if he is honorable, a beautyful daughter whose potential is only limited by her surrondings.
Anna did plan on Howard being buried next to her. If you have been following the news it was stated that each plot holds 2 burial sites. She bought 2 plots which equals 4 burial sites. Anna, Howard, Daniel and Dannilynn

It seems that an issue will be whether the alleged marriage between Stern and Smith was valid. In many jurisdictions, a significant event, such as a marriage, invalidates a will. If Stern is her husband, he may well be a beneficiary under the laws of many jurisdictions, so long as a will that post dates the marriage was not executed. In short, much more to come.
