I do not understand why James Brown's common law wife is kept out of the home they shared with their son. It sounds that Mr. Brown's family are so jealous and afraid that his youngest son will get more than thay do, which I feel would be the right thing to be done. His other children are older and unless they are really hurting that bad for money should see that the youngest of Mr. Brown's children and his mother that is their half brother whether they like it or not.
My family always believes that if a sibling is born in the family even if it is born out of wed lock that child is family even if some some of the family do not believe in having a child out of wedlock. Do not let that keep the other family members from treating him or even his mother as if they do not belong. Quit being so jealous and act like a family even though his children are from other marraiges. Just try and get along. The attorney really needs to try and draw everyone together instead of having them fighting among each other.

Some states do not recognize 'common law' marriages. Many women who have lived with a man for great numbers of years have found if their state did not recognize a common law marriage, or had requirements to determine that status, have been left out of the legal process... they all need to check their status before going into this relationship.

The article states that Mr. Brown has a trust. A trust states who retains control over Mr. Borwn's assets at the time of his death. It is supposed to state how his estate is to be handled with respect to any heirs. Any children he fathered, whether biologically or adopted, should be treated fairly. All the 'baby mamas' should stay out of it. Death and probate brings out the ugliness in folks.

The article said it had been several weeks since the couple had seen each other...early this morning, reports were that the 36 year old 'wife' was away 'on retreat'. Another report added that it was a 'beach retreat'. I want the rest of the story. One of Brown's assistants said he wasn't feeling well but that excitement over preparations for the New Year's celebration kept him from seeking medical help. Then, during a dentist visit in Atlanta, the serious nature of his condition forced the hospitalization...and the 'wife' is on a retreat? Give me a break - that's enough reason to lock her out of the property! When she failed to show up upon learning that her 'husband' was in the hospital, she gave up her claim as a grieving widow. May God bless the hardest working man in show business - and his family.

I would like to first say that inspite of Mr. James Brown's problems, he truly was a legend. He truly did make an impact, not only on his generation, but to younger generations. And if we will all be honest, most of us know that it is for the money and the attention. And sometimes, it truly is love. In all honesty, only God knows if she truly loved him or if she just loved his money and fame. This is a lesson to all of us, which is, our motives should be right in all that we do. The matter will be resolved, once her lunk-head attorneys look at how South Carolina handles Common-Law marriages. In Illinois, if a man and woman are in a relationship and live together for more than 7 years, the relationship can be considered a Common-Law Marriage & the parties can petition for benefits each person has if they allow them to be covered. If the South Carolina law doesn't allow this, she may be S.O.L.
I feel bad more so for the five year old, than I do for her. If she truly had her marriage anuld, she should have made sure that all the i's and t's were dotted and crossed. Sure, she followed her heart and the money, but so do attorney's...more so the latter. From what I can understand, she was locked due to legalities of his estate. She should have taken care of these things before this tragic event. For instance, get married legally. How can this be possible? I have a tenant in my rental property that hasn't paid any rent for 2 months, but legaly I cant kick him out for 90 days. If I would lock my tenants out MY OWN HOUSE that they rent from me, they could sue me right away.
Regardless of the race, reality is there is a child involved. The two should be allowed to live in the home until the estate is settled. I find it amazing how easily it is for people inside and those on the outside to quickly throw stones. Be kind and let the woman in her house. It's a shame she wasn't prudent enough to save money while she was with James Brown or while she was working for him as a back up dancer. But it's also not right to turn someone out of their home, especially with a young child, onto the streets unnecessarily.

This lawyer is doing his job to protect the assets of the estate, but he is making a very serious error in locking out the mother of one of James Brown's children. Even if she does not have a legal right to be there (and I think she does) the MINOR CHILD has every right to live in that house. He also has the right to have his mother there to take care of him. He's only 5 or 6 years old and he's being locked out?!! That's outrageous and I think that in the end, this woman will be paid a handsome settlement. The child will also receive support from the Estate, which will basically go to Ms. Brown, as his mother. Perhaps the Common Law thing is based on having fathering a known child? In any case him being deceased, she is entitled to at least child support if custody is rightfully hers. So the lockout maybe frowned upon by the State or Family Services and force another hand into the matter if there is an entitlement.

The topic seems to be black and white to me, a audit should be done on Mr Browns tax records. Did he claim, or didn't he claim (Miss Hynie) and their 5 year old son as dependents for the past five years. If the answer to these questions are yes, and I am sure the answer will be yes, she could have more leverage in court. This matter will be worked out in a court of law, not on a blog page. Out come will be Lawyers millions, family thousands.........

I can't believe 'Gravy' made the comment about 'blacks hating on whites'... I didn't see where anybody on here identified with a specific race. Based on some of the comments, though, there are a lot of whites on here who condemn her because she was with a black man. Why is that even important? The most important person in this situation right now is the child. He didn't choose to be here, but once he was born they both have a responsibility to him until he can take care of himself. The other children should at the very least take that into consideration. Hopefully this mess will be cleared up soon. I'm sure that Mr. Brown has made adquate arrangements for his son to be taken care. His lawyer stated the home had been 'left in trust to his children'. Tommi Rae states that the home was 'left for her to live in for as long as she wants, then the home is to be turned over to the state of South Carlonia to be turned into a museum'. Someone isn't telling the truth, but no matter what that person has to live with thier lie, not you and not me.

This whole situation is problematic:
If this had happened to a white/white couple, I would be outraged at all the parties involved. Sleeping with another person while married is considered wrong by most white persons.
To add the elements of racial misceginaton (that is race-mixing for all you christers and pansies) is to add a level of tragedy which only responsible white people can understand. This woman crossed all the lines; and anyone who knows an unfortunate like Tami Raye, knows that the white female is the greater loser - she has to share the memories of this laison, and will have to live with her child which will never be accepted by decent white people.
Blacks should condemn this as loudly as possible...white gold diggers are more attractive than most black females to up and coming blacks entertainers, and this behavior should be condemned as loud as possible by both races.

People can say and write what they want to about the marry and James Brown. We are all human and people make mistakes. We just need to pray for the Brown's family and the rest is unknown. Be at peace for his singing and what he gave to the world while he was living. It no need to think or worry about it now because as long as he was living he was James Brown but when we pass to the next world all things comes to life. The world knows that James Brown and his female person was not getting alone and they are not the only ones so why makes a big deal out of it but that the way this world is. Only James, her, the family knows the public with really never know. It is just entrainment for the public but pain for the family. James Brown will be missed mostly and truely by his loves one and his family. Pray and give them strength.

This is such a disgrace; people talking about race. James Brown considered this woman his common law wife. They both had a child together. Where is the compassion and the love of God that should be in your heart. I personally have never heard anything about Tammi Rae; but from what I saw on Sunday, December 31st she seems like a perfectly decent woman to me with a beautiful son. The thing to remember here is that James Brown knew she was white - so HELLOOOOOOOOOO! Shame on all of you; we are all God's children made in his image and likeness.

Maybe James did not want to marry her, who knows, who cares. However, they shared a bed and a son was conceived through that union. That child did not ask to come here, neither did he ask to be fatherless. Someone should see that he receives something from his Father. Surely his Father must have taken care of him while he was alive, or we would have heard about that to.

Some of you forget that James Brown did not have just one child--he had several children and they ALL are entitled to proceeds from his estate--it doesn't matter if they are grown or minor children. That is why he has a lawyer, a will, etc. It is also evident that this Tami did not live with James Brown nor does she fit the legal description in most states of a common-law partner and they also had separate residences. I feel this Tami woman is upset because her 'gravy train' has jumped the track--forever. As for her and James Brown's son--it will be up to his lazy-butt mother to take care of him until the estate is settled. She should've thought of that before her trifflin' behind got pregnant by a 73 year old man--no matter what color he is.
