So, this guy knew bin Laden and knew bin Laden was an un-convicted criminal. An un-convicted criminal is not a criminal at all because our law assumes people are innocent until convicted to the contrary. So, this guy was driving an innocent (in the eye of the law) guy around.

What if all taxi drivers assume everyone in New York is guilty of something. Does that make all taxi drivers guilty if they happen to get a fare that is an un-convicted criminal?

This sounds way to problematic to me. In the United States even un-convicted criminals are allowed to be driven around.

Was there evidence that Hamdan drove bin Laden to an event where known criminal activity was going to be committed? Like a getaway car for a bank robbery?

The lack of information is a tragedy and lends itself to question the trial and if justice has been done.

Sorry Lance, there is more to this than being the bodyguard of a so called unsentenced terrorist .He knew Bin Laden to be guilty of the bombing of the US embassy in Nairobi and also the attack on the twin towers .Are you realy considering all this is of no importance until he is actually condemned for it .What a madness and lack of understanding simple ethical rules .You don't work for anybody that commits such heinous acts .Your anti-american predisposition is leading you into a moral abyss.Think again ...
I think the sentence was correct in proportion to his deeds. His conditions of detentions however were not, neither was the very principle of him standing accused in front of a military US court that holds no jurisdiction .Many flaws in the system ,but not in the result .

...the court, I am afraid has EVERY legal standing, in the United States of America. We determine this by bucking it up to the highest court in the land.

Yes, you can jack off at the IOC all day long, but at the end of the day, the Dance with the Stars judges have as much jurisdiction as the IOC, in America.

Just as it should be. If johnny Haj gets off in 5 months, fine with me. Hopefully, a U.S. sniper will find him in the field, and deliver the final sentence.

Honestly, it just flabbergasts me on how the rest of the world views Constitutional law in a democratic republic. They actually think we make it up as we go. Just look above.

'He knew Bin Laden to be guilty of the bombing of the US embassy'

... as I know that Bush is guilty of bombing (ordering the bombing of) many structures in Iraq and killing many people in the process. So what. Just because someone flies Air Force One (and Bush around) does not make them a criminal, for example. Perhaps Bush may be convicted one of these days, but I hope his pilots are not also convicted. That is unless the pilot killed someone while flying or something like that.

No, I am afraid that you do not get the point of the law.

If Hamdan committed a criminal act or was involved in one directly then that is one thing. But, if he drove around a suspected criminal while not doing criminal activity then that is another.

...he's guilty. He aided a known terrorist. We proved it in court a legitimate court according to US law. He served in an outlaw army and, according to our laws, he hangs.

Bush is the head of a legitimate nation-state. As such, he has powers boner boy haji does not. He can order acts of war, on command, according to our laws.

Grow up. Inform yourself.

'Bush is the head of a legitimate nation-state. As such, he has powers boner boy haji does not. He can order acts of war, on command, according to our laws.'

Well, you have a point there ... almost. There is also the issue of jurisdiction and other matters. But lets not split hairs. In the U.S. no one is above the law. It is just that certain laws do not apply to certain people. For example: The president can order the flesh burned off of little children (for example with napalm) whereas the ordinary U.S. citizen can not without a good chance of being convicted if it went to court.

So, I concede your point; although it is not a point to be proud off.

What is your chronological age? Your posts indicate a mental age of less than 5 years old. What's this fascination of yours with basements and mommy? Does that come from your living in a dank hole and when what was supposed to have been your mother ran away, after she saw the results of your daddy waxing his carrot in a pig? That result was you, by the way. I suppose that I had better put it in simple words that you can understand: Your daddy was a pig porker, and what was good enough for him, is good enough for you.

I noticed that Hitler's driver was not prosecuted for anything. He probably didn't know anything about all the war crimes that the nazis were committing during WWII. This idea is very credible, since most good Germans didn't know anything either, and were totally unaware of the atrocities and war crimes that were occuring then right in their own backyards. These good Germans were not prosecuted, nor should they have felt guilty of anything except being patriotic, and loyal to their Aryan cause. Hitler, practically alone, but at times with a few top henchmen, committed all the countless acts of evil.

Hamdan, on the other hand, was alleged to be in the inner circle of the al qaeda, holding top level jobs like car driver. He was most definitely one of the 'worst of the worst'. It is certainly fair and reasonable to expect that his proposed punishment of 30 years in military prison would serve American justice very well. Most Americans have been led to believe that he should be executed for the outrageous war crime of driving his boss's vehicle, and trying to do his job. It is a total outrage to the American justice system that this military tribunal did not sentence this top terrorist to death, or at least 30 years in prison. Even though he supposedly did not commit any war crimes, he must be a war criminal. If they wanted to show some degree of mercy to this islamofascist enemy combatant/noncombatant animal then a 30 year sentence, instead of a death sentence will demonstrate just how magnanamous, and religiously grounded the Americans really are. But a mere 5 years is totally unacceptable.

Sorry but I stick to my position .There are a few principle tha apply to laws .When you associate yourself with a criminal in his criminal organisation ,yo are an accomplice .If you are driving Bin Laden around by every principle of law you are an accomplice, unles you don't know who you drive around,or unles you can claim innocence to the knowledge o his evil deeds .It thought this was simple enough to understand Lance, think it over again.Every state has this kind of laws .read the article;the driver found out that Bin Laden was the perpetrator of bombings that costed thousands of lives .These heinous crimes were not directed against Bus but against the american people by the very nature of the casualties.Failing to agree on that is in fact adopting the same point of view as the terrorists:every american is a legal target ...It's simply horrible ,I'd urge you to think over this kind of attitude,or soon there will only be a very thin line between you and the very people you condemn.
Were the casualties of Nairobi and Twin Towers victims of Bsh or Bin Laden? How confused can you get ?Did the driver of Bin Laden knew that?Yes he did .Is 5 years in jail the just sentence for associatibng yourself with Bin Laden in a terrorist organisation ?Yes it is,it is the right ssentence for a small footsoldier that only perormed minor crimes .Surely you agree to that ?

I always knew that the so-called miltary tribunals would be a disaster for American justice, ever since they were approved by the libnazi- oriented supreme court. Our guys had a chance to just make these 'worst of the worst' enemy simply 'disappear' while they were resorting at gitmo. Instead they made most of them reluctantly return home after they were treated to their all expenses paid vacations where they lived in the equivalence of 5 star accomodations. After those ungrateful bums were kicked out, there were only a handfull left who required the heavy hand of justice. But, where death sentences were to be expected to be given to these war criminals, the libnazis again interferred and rigged the tribunals so justice was not served. 5 years only, for being a driver, is a disgrace, and sorry to say, the defeatocrats prevailed, perverting American justice once again.

I'm happy with all this. The best part: Johnny Haj can, at the end of his sentence, be held as P.O.W. indefinitely, as this war can go on forever....very hard to armistice with a terrorist enemy...ya knoow?
