Claim Against Eminem Thrown Out
By James Wray Apr 16, 2005, 8:23 GMT
US Rapper Eminem has won a court battle over allegations he falsely depicted a former schoolmate in his song Brain Damage.
DeAngelo Bailey claimed the line in the song, "I was harassed daily by this fat kid named DeAngelo Bailey," painted him in a falsely negative light and sued Eminem for $1 million in 2001. However, he has since admitted in interviews that he did bully the star but says not the extent the song implies.
Judges ruled that a decision made in 2003, which found that the song should not be taken literally was correct and dismissed Bailey's claim.
Bailey's lawyer said he did not intend to appeal the decision.
