John Schindler says the two actors prevented the theatrical release of the 1995 independent movie Don's Plum.
However, DiCaprio and Maguire say that they took part as a favour to the producer under the terms it would be released as a feature-length film.
The legal action alleges the actors scared off potential distributors by warning that DiCaprio would not work with them on any other projects if they released the movie.
Mr Schindler is seeking $38m in damages according to court papers filed in Los Angeles.
This is not the first legal action resulting from the movie. Back in 1999 both actors settled with another of the films producers. David Stutman raised an action that was settled out of court for $10 million. Allowing the producers to market the movie outside of the USA and Cananda.
Neither DiCaprio or Maguire have made any public comment regards this latest case.
Sour plums indeed...

It was nice of Tobey & Leo to appear in a film for a friend-Perhaps they should have thought..'Maybe people will see this film'..before they showed up for their call time. Perhaps the 'stars' forget People make films and people need to eat and get paid. There is nothing fun about working for free.
